Legal issues like patents, trademarks, copyrights, etc., are one of the critical aspects for the companies. The companies setting up a business have to be legally strong enough to stay away from any legal trouble. The local laws must be taken care of before establishing a business. Taiwan attracts a lot of foreign companies for manufacturing and business. Deep & Far is one of the most renowned legal firms in Taiwan, which has many reputed international clients. We had a conversation with the CEO and Founder of the firm, Mr. C. F. Tsai. Here are some of the key points from the conversation.

What was Deep & Far’s focus a few years after establishment, and what is it today?

Deep & Far Attorneys-at-law was founded in 1992 and had been aiming at dealing with all phases of laws. Today, Deep & Far focuses more on all aspects of intellectual property rights (IPRs), including patents, trademarks, copyrights, trade secrets, unfair competition, and/or licensing, counseling, litigation, and/or transaction.

Can you tell us about the patent filing services you offer?

Deep & Far prosecutes worldwide patent matters for local clients. For international or foreign clients, Deep & Far prosecutes patent matters mainly in Taiwan, significantly in Mainland China & Hong Kong. Deep & Far prosecutes in every field, such as mechanics, chemistry, pharmacy, biology, electronics, optics, telecommunications, and computer sciences.

The patent attorneys and patent engineers in Deep & Far normally hold advanced degrees and have graduated from the top three universities. Our staff is dedicated to providing the best quality service in IPRs in this country. As a proof, more than one-fifth of the top 100 incorporations have used our services. Furthermore, Hi-Tech companies in the science-based industrial park located at Hsin Chu have also played an important role in booming Taiwan’s economy. About one-half of them has experience in seeking patented their techniques, and more than 50% of the patent-experienced companies in the park have ever entrusted their IPR works to us. The international giants include Armani, Baidu, Beckhoff, BYD, CICC, Chep, Cypress, Dr. Reddy, Gleason, and many others.

Brief us about the IPR services you offer.

We have profound experience in dealing with all aspects of IPRs, including patents, trademarks, copyrights, trade secrets, unfair competition, and/or licensing, counseling, litigation, and/or transaction. How does your firm help the clients to maintain their trade-related secrets?

We propose Confidentiality Agreements for the clients and suggest the clients to properly mark all confidential information, to categorize the confidentiality level for each confidential information, to formulate a standard internal system for maintaining the confidential information, to periodically hold internal education seminars to propagate the importance of trade-related secrets and related law issues, and to alert the clients with resignation interview of any resigned employee.

What do you find most challenging about your practice?

There are more and more competitors, so it becomes more and more drastic to educate and retain clients.

Does the firm offer any outside training opportunities?

Yes, our managing persons regularly provide speeches or training programs to clients, academic units, or other units.

Can you tell us about a memorable case/deal/issue you worked on?

We are Taiwanese agents of the Cirocomm Technology Corp. (hereinafter Cirocomm) who sought to claim the exclusive rights of Taiwan Invention Patent No I635650 entitled “Filter Structure” (Invention Patent), Taiwan Utility Model Patent M539186 entitled “Filter Structure” (Utility Model Patent), a Taiwan Design Patent No D184079 entitled “Filter,”

and copyright of the works on the Cirocomm’s filter products (Work at issue).

We have represented Cirocomm to initiate several criminal litigations based on copyright law and initiated civil litigations based on the patent law and the copyright law against the Infringers. We also planned to initiate criminal and civil litigations based on trade secret law.

There are three main Infringers, where one is a Chinese company, and the others are Taiwanese companies. Currently, Cirocomm and one of the Taiwanese companies will settle, and the other Taiwanese company expressed very strong intent to settle with Cirocomm.

What makes your firm stand out from other lawsuits?

We have profound experiences for any proceedings of lawsuits, so we can give the client the most favorable strategies in any proceedings to let the client get the best position for claiming rights. We always keep close, timely, and smooth communication with the client, so the client can always have complete information about the cases and have enough time to come up with the most reasonable strategies. Therefore, the client usually can gain enough benefits even though they finally do not win the case in the appearance.

About the Founder

Mr. C. F. Tsai is the Founder and CEO of Deep & Far. He is the first patent practitioner in Taiwan who has both technological and law backgrounds and is qualified as a local attorney-at-law. He is also the sole practitioner who passed the Taiwan bar (or high) examinations both in technological and law fields. He majored in his marine engineering background at National Chiao Tung University. He finished his law degree from National Taiwan University and a master’s law degree from Soo Chow University. He founded Deep & Far Attorneys-at-law in an effort to offer insurmountable services.
